Accounts

• Users must create an account and verify their email address before accessing any content on the site, including free first chapters.
• You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
• You represent and warrant that all information provided during registration is true, accurate, current and complete. We reserve the right to suspend or terminate accounts where false or misleading information is provided.
• Admin and licensor access is role-based and restricted to approved users only. We reserve the right to modify or revoke access roles at any time.
• Accounts that have not been accessed for more than twelve (12) consecutive months may be suspended or deactivated at our discretion. We will make reasonable efforts to notify you in advance via your registered email address before any such action is taken.
• We will not be liable for any loss or damage arising from unauthorized use of your credentials.

Digital Reading Access

• The first chapter of each title may be made available at no charge after account registration. All remaining chapters require purchase.
• When you purchase a digital chapter or volume, access is unlocked on your account. All digital purchases are tied to your account and are non-transferable.
• Purchased digital content is licensed for your personal, non-commercial reading only. You may not copy, reproduce, redistribute, share, sublicense, resell or otherwise make digital content available to any third party.
• Digital content is delivered via browser-based streaming and is not available for download or offline access unless explicitly stated otherwise.
• Your access to purchased digital content is contingent on your account remaining active and in good standing. If your account is terminated for a violation of these Terms, you will lose access to all purchased digital content and no refund will be issued.
• We reserve the right to implement technical measures to prevent unauthorized access, scraping, automated downloads, screen capture or any attempt to extract or redistribute content.
• We reserve the right to suspend or terminate account access for any violation of these Terms, including paywall circumvention, payment fraud or unauthorized sharing.

Payments

• All payments are processed through Stripe or other approved payment providers. By completing a purchase, you agree to the payment provider's terms and conditions.
• Prices for digital content and physical goods are subject to change without notice at our sole discretion.
• All digital good purchases are final unless a payment processing error or technical failure has occurred. Please refer to our Refund Policy for full details.
• We reserve the right to cancel or limit orders at any time and for any reason, including suspected fraud or abuse.

Physical Orders and Preorders

• Physical book orders require a valid and accurate shipping address. We are not responsible for orders lost or delayed due to incorrect address information provided by the customer.
• Preorder titles are paid in full at the time of order. Preorder items ship on or around the listed release date, which we reserve the right to change at any time.
• If a physical order includes both in-stock and preorder items, the entire order may be held until all items are available to ship.
• Physical orders may be subject to import taxes, customs duties or other fees upon delivery. These charges are the responsibility of the recipient.
• If you receive a damaged physical item, you may submit a claim for a replacement or refund. Proof of damage must be provided with your claim.

Campaigns and Crowdfunding

• Campaign pledges support specific print goals. Pledging does not guarantee a reward if the campaign goal is not met.
• If a campaign does not reach its stated goal, eligible pledges may be refunded in accordance with our Refund Policy.
• We reserve the right to modify campaign terms, goals or timelines at any time and will communicate material changes to pledgers.

Intellectual Property

• Unless otherwise stated, Crossed Hearts and/or its licensors own all intellectual property rights for content, titles, artwork, logos and site materials published on this website. All rights are reserved.
• You may not republish, reproduce, duplicate, copy, sell or redistribute any material from this website without prior written consent.
• No use of Crossed Hearts' name, logo or brand materials is permitted without express written authorization.
• You may not create frames around our web pages that alter the visual presentation or appearance of this website without our prior written permission.
• Links to this website are permitted provided they are not deceptive, do not falsely imply sponsorship or endorsement by Crossed Hearts and are not associated with content that is unlawful, harmful, obscene, defamatory or otherwise objectionable. We reserve the right to request the removal of any link to this website at any time.

Copyright Infringement (DMCA)

Crossed Hearts respects the intellectual property rights of others and expects users to do the same. If you believe that content available on this website infringes a copyright you own or control, please notify us by sending a written notice that includes:

Prohibited Conduct

• You agree not to attempt to bypass, circumvent or defeat any paywall, reader protection, payment check, account security measure or territorial restriction implemented by us or our licensors.
• You agree not to upload or transmit any malicious software, viruses, bots, scrapers or automated tools that may damage or interfere with the operation of this website or harm other users.
• You agree not to use any robot, spider, site search or retrieval application or any other automated device to index, scrape, data mine or otherwise reproduce or circumvent the structure or presentation of the website without our prior written consent.
• You agree not to transmit unsolicited bulk communications, spam, or chain messages to other users or through the website.
• You agree not to engage in any conduct that defames, harasses, threatens or abuses other users or Crossed Hearts personnel.
• You agree not to post or transmit content that promotes racism, bigotry, hatred, violence or illegal activity or that is obscene, defamatory or otherwise objectionable.
• Violation of any of the above may result in immediate account suspension or termination and we reserve the right to pursue any remedies available to us under applicable law.

Unsolicited Submissions

Crossed Hearts does not accept or consider unsolicited creative ideas, story submissions or other creative materials. Any unsolicited information you send us — including ideas, concepts, suggestions or other content — will be received on a non-confidential basis and may be used by us for any purpose without compensation or acknowledgment to you. This policy is in place to avoid misunderstandings if future projects developed by Crossed Hearts appear similar to materials that were submitted unsolicited.

Disclaimer of Warranties

We do not guarantee that this website will be uninterrupted, error-free or free from viruses or other harmful components. The website and all content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by applicable law. We do not warrant the accuracy, completeness or reliability of any content available on or through this website.

Limitation of Liability

To the maximum extent permitted by applicable law, Crossed Hearts (Winterberry Dreamspace LLP), its officers, employees, agents and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, loss of data or loss of access, arising out of or in connection with your use of or inability to use this website or its content. Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the website shall not exceed the amount paid by you to us in the three (3) months preceding the claim.

Governing Law and Dispute Resolution

These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of India. Any legal proceedings arising out of or relating to these Terms or your use of this website shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India. By using this website, you consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such claim. Any cause of action you may have with respect to this website must be commenced within one (1) year after the claim or cause of action arises or it shall be deemed waived.

Severability

If any provision or portion of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
